Bankruptcies are filed under the following chapter headings:
Chapter 7 — Outright bankruptcy: the debtor relinquishes non-exempt assets and the debts are forgiven.
Chapter 11 — Allows companies and individuals to restructure debt in order to repay it.
Chapter 12 — Allows family farmers to restructure their finances to avoid liquidation due to foreclosure.
Chapter 13 — The plan is developed by the person to pay off a percentage of the debt based on ability to pay. All disposable income must be used to pay off debt.
